Seoul, Korea - The hot topic in display industry is when Samsung Display and LG Display will finally bury the hatchet, as they recently went into a reconciliation mode.
The CEOs of two companies and Jaehong Kim, the head of Growth Engine Division at the Ministry of Knowledge Economy gathered together and agreed on a conciliatory principle, and the bitter legal dispute over the last six months came to a lull. The two CEOs agreed on the framework and left the details to be worked out by their people, but there had been no working-level meeting regarding this matter for two weeks. The trade’s curiosity on whether the further negotiation will take place is amplifying.
It was Samsung to make the first gesture of reconciliation. Samsung filed an injunction asking the court to prohibit LG from using the OLED technology leaked therefrom, and the court was to rule on the request this month. Samsung withdrew its injunction filing as soon as the lunar new year holidays was over.
With Samsung’s withdrawal, the ball is now in LG’s court, but LG Display has not made any move at all. Experts agreed that the most meaningful action LG can take must be to withdraw the filing for injunction for production and sales ban for Galaxy Tab 10.1.
Other than the withdrawn injunction filing, there are still four infringement and nullification lawsuits in progress.

해빙 분위기에 들어간 삼성디스플레이와 LG디스플레이의 분쟁이 언제 종결될지 업계의 관심이 쏠리고 있다.
지난 4일 양사 대표가 지식경제부 김재홍 성장동력실장과 함께 만나 화해의 원칙을 세우면서 반년 동안 골 깊은 법정 싸움은 일단 소강상태에 접어들었다. 두 대표는 원칙만 합의하고 세부사항은 실무진 협의를 통해 결정하겠다고 밝혔다. 하지만 2주가 지나도록 협상 조짐이 보이지 않아 이후 진척 여부에 궁금증이 증폭된 상황이다.
화해의 제스처는 삼성디스플레이가 먼저 취했다. 삼성디스플레이는 지난 설 연휴가 끝나자마자 가처분 소송을 취하했다. 이 소송은 수원지검이 LG디스플레이 임직원과 전·현직 삼성디스플레이 연구원들을 기술유출 혐의로 기소하자, 삼성디스플레이가 LG디스플레이를 상대로 낸 소송이다. OLED 기술유출 관련 삼성의 세부 기술을 LG가 사용하지 못하게 해달라는 내용이었으며, 이달 판결을 앞두고 있었다. 삼성이 설 연휴 직후 가처분 신청을 취하한 것은 판결이 나기 전 사태를 해결하기 위함이었던 것으로 풀이된다.
이로써 공은 LG로 넘어간 상태다. LG디스플레이는 가처분 소송 취하 소식을 접하고도 아직 움직임이 없다. LG디스플레이 관계자는 “사태 해결을 위한 방안을 다각도로 검토 중”이라고 말했다.
전문가들은 LG가 취할 수 있는 가장 빠른 방법이 `갤럭시탭 10.1 생산 및 판매 금지 가처분 신청` 취하일 것이라고 진단했다. 아무리 자존심과 경쟁의식 때문에 시작된 싸움이라고는 해도, 기업의 자산이 걸린 특허 소송을 취하하려면 별도의 협상을 거칠 가능성이 높다. 특허 침해 소송을 취하하면 다시 권리를 주장하기는 힘들기 때문이다. 가처분 신청을 제외하고 4건의 특허 침해 소송과 무효 소송이 진행 중이다.
업계는 양사의 분쟁이 시급히 종식되기를 바라는 모양새다. 두 회사에 부품이나 설비를 공급하는 협력사들은 싸움의 불똥이 튀지 않을까 노심초사해왔다.
업계의 한 관계자는 “특허전 때문에 부품 사업에 타격을 입는 것은 아닌지 걱정이 많았다”며 “서둘러 사태가 마무리되기를 바란다”고 말했다.
