SEOUL, KOREA – A small-sized Korean firm, specializing in the commercialization of patented inventions and consulting services, has filed a patent infringement suit against Apple. Biz Model Line said Tuesday after finding out that Apple had infringed on its patents, it filed for a declaratory judgment on the scope/extent of a right against Apple last month.
Except form Samsung Electronics, Biz Model Line is the first Korean SME that has filed a patent infringement suit against Apple.
The filing for a declaratory judgment on the scope/extent of a right is the foremost step towards verifying patent violations in a patent dispute.
Biz Model Line owns a patent on a direction finding system for mobile terminals, a technology that shows a map in the same direction as the user’s movement and helps the mobile device display a map without losing its bearings when the mobile phone tilts or changes its position. This technology is essential to mobile map services, so it is being used as one of the major functions of the iPhone’s map app.
According to Biz Model Line, Apple that used to offer Google maps newly developed a map app for the iPhone and has been providing the new app as a basic map service since September of last year.

비즈모델라인, 애플이 특허침해했다
국내 중소기업이 자사가 보유한 특허를 애플이 침해했다며 소송을 제기해 주목된다.
비즈모델라인(대표 김재형)은 애플의 아이폰 지도앱이 자사의 특허를 침해한 것으로 확인돼 지난달 특허심판원에 애플을 상대로 권리범위확인심판을 청구했다고 26일 밝혔다.
국내에서 삼성을 제외한 중소기업 중에서 애플을 상대로 특허 침해소송을 제기하기는 이 회사가 처음이다.
권리범위확인심판은 어느 특정기술이 등록된 특허의 권리범위에 속하는지 여부를 공적으로 확인하는 심판으로, 특허분쟁시 특허침해 여부를 확인하기 위한 가장 기본적인 소송절차다.
비즈모델라인이 보유한 `이동통신단말용 방향 탐지 시스템` 특허는 사용자가 휴대폰에서 지도를 확인할 때 사용자가 바라보는 방향(휴대폰이 향하는 방향)을 지도에 표시해주고, 휴대폰의 방향을 바꾸거나 기울여도 지도가 항상 일정 방위를 유지하도록 해 주는 기술이다.
이는 휴대폰에서 지도 서비스를 제공하기 위한 필수적인 기능으로, 아이폰 지도앱의 기본적인 주요 기능으로 이용되고 있다.
비즈모델라인은 애플이 그동안 구글 지도를 아이폰의 기본 지도로 제공해왔으나, 새롭게 아이폰 지도앱을 만들어 지난해 9월 아이폰 운영체제를 iOS6로 업그레이드하면서 기본 지도로 제공하고 있다고 밝혔다.
비즈모델라인 관계자는 “회사가 보유한 고유 특허를 침해한 기업에 대해 권리를 행사하는 것은 당연한 것”이라며 “심판 청구 결과에 따라 차기 침해 소송 여부를 결정할 것”이라고 말했다.
