SEOUL, KOREA - SK Hynix (represented by Park Seong-wook) announced on May 9 that the US District Court for the district of California judged that Rambus, a company in a patent litigation with SK Hynix, illegally destroyed evidence. The court has ruled at the original trial that USD 250 million should be reduced from the initial damages SK Hynix was supposed to pay to Rambus.
Back in 2009, the first trial ordered the local semiconductor maker to pay some USD 400 million to cover damages on the infringement of a patent owned by Rambus. But in an appellate trial in 2011, the US Court of Appeals annulled the original decision.
Considering the illegality of Rambus, SK Hynix says the judgment falls short of their expectations compared withthe result of a similar case of Rambus vs. Micron. The local company adds that they would lodge an appeal if the final decision is made the same as the original one.
Rambus is a company that holds a number of patents on memory semiconductor and is called a ‘patent monster’ as it has indiscriminately filed lawsuits against DRAM memory semiconductor makers since 2000.
램버스, SK하이닉스와 소송서 불법 증거 파기
SK하이닉스(대표 박성욱)는 미국 캘리포니아주 연방지방법원이 자사와 특허 소송 중인 램버스가 불법으로 증거를 파기했다고 판시했다고 9일 밝혔다. 법원은 원심에서 SK하이닉스가 램버스에 지불하기로 한 손해배상액에서 2억5000만달러를 감액하라는 결정을 내렸다.
지난 2009년 1심 판결은 SK하이닉스가 램버스의 특허를 침해했다는 이유로 약 4억달러를 배상하라고 명령했다. 하지만 지난 2011년 항소심에서 연방고등법원은 램버스가 소송과 관련된 증거를 불법으로 파기했다며 원심 판결을 파기 환송한 바 있다.
SK하이닉스 측은 램버스의 불법성을 고려할 때 이번 판결이 유사한 사례인 램버스·마이크론 사건에 비해 기대 수준에 못 미친다며 조만간 같은 최종 판결이 나오면 항소하겠다고 밝혔다.
램버스는 메모리 반도체 특허를 다수 보유하고 지난 2000년부터 D램 메모리반도체 업체를 대상으로 전방위적으로 소송을 걸어 `특허 괴물`로 불린다.
