Seoul, Korea - Korea Fair Trade Commission (KFTC) has sent its Market Watch Division investigators to the headquarters of Daum in Hannam-Dong on 27th to conduct on-site inspection.
After the Commission conducted the on-site inspection of NHN headquarters on last 14th, the second largest Korean portal was also scrutinized. The fair trade inspection on a market leader whose market share surpasses 70% is not a surprise, but Daum being investigated came as a surprise to the trade, making the insiders to anticipate that the portal market in general will be investigated by the Commission.
KFTC says it will check if the Daum have abused its market dominant position and if it violated Fair Trade Act – i.e., if Daum has forced its contents providers to take unfavorable contract terms or unilaterally canceled trade agreements.
The Commission will also investigate if Daum has provided preferential treatments to its subsidiaries, such as providing favorable support or channeling all its businesses to its subsidiaries. The trade is keeping a keen eye on whether its keyword search business will also be scrutinized.
The recent movement of KFTC, including the inspection of Daum, shows KFTC’s intention to find out if the portals are committing unfair business practices to its contents providers using their positions as the portal sites, and in doing so, the sizes of portals would not matter. The investigation is likely to continue to other portals, such as Nate. Depending on the outcome of a series of investigations, KFTC may start reforming the overall practices in the industry, especially on the procurement and distribution of contents by the portals.
공정위, 다음도 전격 조사…全 포털로 확대되나 업계 `덜덜`
공정거래위원회가 포털 다음에 대한 조사에 전격 착수했다. NHN에서 시작된 `포털 손보기`가 전방위로 확산되는 모양새다.
공정위는 27일 오전 시장감시국 조사관을 서울 한남동 다음커뮤니케이션 본사에 보내 현장 조사에 들어갔다.
지난 14일 NHN 본사 현장조사에 착수한 데 이어 포털 업계 2위 다음으로 조사가 확대됐다. 검색점유율 70% 이상을 차지하는 1위 네이버에 이어 다음도 전격 조사를 단행함에 따라 공정위가 국내 주요 포털사업자 전반을 모두 들여다보려는 것이란 관측이 힘을 얻고 있다.
공정위는 다음의 시장 지배적 지위 남용 및 공정거래법 위반 여부를 조사한다. 다음이 콘텐츠 제공업체(CP)를 상대로 단가 후려치기 등 불리한 계약 조건을 강요하거나 일방적으로 거래 계약을 파기하는 등의 불공정 거래 행위를 했는지 살펴볼 것으로 알려졌다.
8개 계열사에 특혜성 지원이나 일감 몰아주기 등이 있었는지도 조사한다. 올해 초 시작한 자체 검색 광고 사업 조사도 이뤄질지 주목된다.
NHN과 거의 비슷한 사안을 조사할 것이란 관측이다. 이날 다음 관계자는 “정확히 어떤 사안을 어디까지 조사하는지는 알지 못한다”며 “성실히 조사에 임할 것”이라고 말했다.
NHN에 이어 2위 사업자 다음까지 조사에 들어가자 인터넷 업계는 당황한 기색이다. 다음은 검색점유율 20% 안팎으로 네이버와는 격차가 크다. 시장 지배적 지위와는 거리가 먼 상황에서 공정위 조사가 시작됐다.
공정위는 NHN 조사를 시작하며 다음•네이트 등 포털 전반의 불공정 거래행위를 조사할 수 있다는 가능성을 열어놓았다. 하지만 그간 공정위는 담합 조사가 아닌 경우 시장 지배력을 가진 선두업체에 조사를 집중해 온 만큼 이번 다음 조사는 이례적 사안으로 받아들여진다.
검색점유율 보다는 다음이 포털로서의 영향력을 이용해 콘텐츠 제공업체에 불공정 거래를 강요했는지가 관건이 될 전망이다. 네이트 등 다른 포털로도 조사가 확대될 것으로 보인다. 포털의 콘텐츠 수급 및 유통 관행 전반에 메스를 댈 가능성도 점쳐진다.
