SEOUL, KOREA - The government is going to thoroughly screen some 14,000 electric construction companies nationwide. If any related company is found to have exaggerated its business performance or have made a fake business report, its business registration will be canceled. And those that are late in making their business reports will be fined.
According to the relevant industry on June 6, a bill to amend the Electrical Construction Business Act would be submitted to the subcommittee of Commerce, Industry and Energy of the National Assembly on June 18.
When the bill is passed, any electrical construction company that is found to have made a bogus report on its capital fund or business performance of the previous year will be driven out of the market. And the concerned person will be given a jail sentence for one year or less or be fined about KRW 10 million. The penalty is only KRW 3 million as now.
If any of them fails to report on a project registration standard, it will be ordered to suspend the business. And when being late in making such a report, the concerned company will be fined. Thanks to the lack of any related regulations, many of the electrical construction companies have so far made the report after a certain period of time, or some have never made any of it at all.
The main purpose of the bill is to filter out so-called ‘paper companies’. The number of electrical construction companies registered on Korea Electrical Contractors Association is as many as 14,000. And many of them are believed to be ‘paper companies’.

정부가 1만4000개에 달하는 전기공사업체의 옥석 가리기에 나선다. 실적을 부풀리거나 허위로 신고한 업체는 등록을 취소하고 신고를 늦게 한 업체는 과태료도 부과한다.
6일 업계에 따르면 이 같은 내용을 골자로 하는 전기공사업법 개정안이 18일 산업통산자원위원회 법안소위에 상정된다.
개정안을 대표 발의한 노영민 의원실은 “해당 법안에 대해 여·야 의원 간 이견이 없었다”며 “이변이 없는 한 6월 임시국회에서 통과될 것”으로 기대했다.
개정안이 통과되면 전기공사업자가 자본금이나 전년도 공사실적 등을 허위로 신고하면 전기공사업 등록이 취소된다. 해당 사업자는 1년 이하의 징역 또는 1000만원 이하 벌금형에 처해진다. 현재는 과태료 300만원이다.
전기공사업 등록기준을 신고하지 않거나 늦게 신고해도 처벌을 받는다. 미등록은 영업정지, 지연 신고는 과태료 부과다. 지금까지는 처벌 규정이 없어 일정 기한 이후 신고하거나 아예 신고를 하지 않은 경우도 많았다.
개정안은 사후관리로 소위 `페이퍼 컴퍼니`를 걸러내자는 게 취지다. 현재 한국전기공사협회에 등록된 전기공사업체는 1만 4000개에 달한다. 등록기준이 낮고 등록신고를 안 해도 아무런 제재를 받지 않기 때문이다.
전기공사업체 한 대표는“2~3개 업체는 기본이고 10개 이상 갖고 있는 사업자도 있다”며 “전체 회원사 중 절반은 페이퍼 컴퍼니로 봐도 무리 없다”고 말했다.
페이퍼 컴퍼니가 급증한 것은 전기공사업 규모가 5년째 20조원 수준에 계속 머무르는 등 성장이 한계에 다다랐기 때문이다. 최근 5년 동안 업체수가 3000개 가까이 늘어난 것만 봐도 알 수 있다. 이처럼 경쟁이 심하다 보니 입찰에 유리하도록 한 사업자가 편법으로 여러 업체를 운영하기도 한다. 특히 지역별 한전 단가계약 업체로 선정되면 2년간은 안정적으로 공사물량을 확보할 수 있어 경쟁이 치열하다.
전기공사 관련 자격증 불법 대여 문제도 심각하다. 업체 등록을 위해 자격증만 빌리는 것이다. 한 달에 50~100만원 수준이다. 자격증을 취업 목적이 아닌 대여용으로 획득하는 사례가 늘고 있는 이유다.
전기공사협회 관계자는 “올해 초 전기공사협회가 허위실적 자진신고를 받은 결과, 20여개 업체가 실적을 허위로 작성해 제출했다”며 “개정안이 통과되면 보다 철저한 사후관리로 선의의 피해자가 발생하지 않도록 해야 할 것”이라고 강조했다.
